trademark (™ or ®) Intellectual property comprising a word, phrase, logo or other graphic symbol, sounds, or colors used by a manufacturer or seller to distinguish its products. In order to receive federal legal protection, a trademark must be distinctive, affixed to a product in the marketplace, and registered with the United States Patent and Trademark Office.Trademarks are perpetual, as long as they are in continued use.The terms trademark and mark are often used to refer to both trademarks and service marks.
