service mark (SM) Intellectual property comprising a word, name, logo or other graphic symbol, or other device used by a company to distinguish its services. A service mark is much like a trademark, but is used to distinguish services, rather than products. In order to receive federal legal protection, a service mark must be distinctive, affixed to a service in the marketplace, and must be registered with the United States Patent and Trademark Office. Service marks are perpetual, as long as they are in continued use.The terms trademark and mark are often used to refer to both trademarks and service marks.
