中国特有的概念。法律上的人事关系，指因劳动而产生的从属性关系，是基于人事管理法而在特定主体间成立的一种雇佣关系。限于“权力、公益”性事业。具体为承载公益服务、公共权力行使使命的国家机关、事业单位及符合要求的社会团体等组织与具体执行者间的从属性身份关系，表现为在录用、招聘、晋升、考核、处分、奖励、工资、福利等方面的管理过程中该组织与所涉国家公职人员和有关履职人员形成的权利、义务关系。
