在刑事诉讼中，如果指控方掌握的证据达不到证明被追诉人有罪的标准，既不能证明被追诉人的犯罪行为，也不能完全排除被追诉人实施了被追诉犯罪行为的嫌疑，就不能认定被追诉人有罪，从而应当终结诉讼的原则。又称若有怀疑则有利于被告原则。刑事诉讼原则之一，无罪推定原则的一个派生标准。
